1. Purpose of the Prixi.us site and designation of the parties
This site can be accessed freely and at no cost by any internet user. Its’ aim is to publish a shopping guide that references goods and services sold by e-commerce internet sites that are themselves referenced on this site.
In subscribing to the services offered by this site, and in creating an account, the user accepts the general terms and conditions of use, and acknowledges him/herself as being fully aware of their content. This acceptation on the part of a user wishing to create an account, consists of ticking a box corresponding to the following declaration: « I have read and accept the conditions of use of this site. » For the user, ticking the box has the same legal value as signing one’s name. The user acknowledges the value of proof of automatic registering systems used by the creator of the present site and except for him to provide evidence to the contrary, will not contest it in the event of litigation. In accepting these general terms and conditions of use, the user must have the necessary legal status to do so, or have the authorization of someone who does in the case of the incapacitated and minors.
2. Object of the site. Usage.
The present site is a shopping guide that references goods and services sold on Internet e-commerce sites which are themselves referenced on this site.
The present site is by no means an exhaustive database of goods and services sold on the Internet, nor of those sites referenced. The internet user acknowledges that the goods and services featured on the site are only those coming from sites that have been referenced and selected by the site administrator.
Searches can be made according to different criterion concerning either goods and /or services and their characteristics (such as price, brand, category) or by vendor.
The present site also offers a certain number of additional « search » tools, such as: price comparison, a search of discounted products, reductions, and new items as well as the possibility of following the evolution of prices of goods and services.
Moreover, registered members of the site have the opportunity of creating and configuring one or more « shopping alerts », whose results concerning the relevant goods and services are sent to them by e-mail.
Members and users acknowledge that the present site can in no way be considered as an on-line vendor. The site does in no way make any sales.
Users acknowledge that all requests for information, all claims relating to eventual disputes concerning the purchase of goods and/or services should be sent directly to the vendor or supplier of the said goods and/or services.
In all cases, should goods or services featured on the site interest a buyer, all steps taken towards the purchase of an item will be re-directed to the vendor or supplier’s website.
Certain information about goods and services will be displayed on this site such as name, description, price and availability, and where possible, an image. This information is in no way contractual and since this information comes directly from the vendor’s website. Prixi.us is in no way responsible if the content should differ from the reality.
Prixi.us publishes on the present site a tool for tracking the prices set by the suppliers referenced on the site and relating to each item and/or service, whereby prices appear as given at the time of their retrieval from the supplier. This information is refreshed by Prixi.us at regular intervals.
This tool, based on the prices displayed on the vendor’s website, depends on the precision of the vendor’s display and on the data that is featured there and therefore is not a guarantee on the part of the present administrator. It is up to the user to check the exactitude of the prices on the vendor’s website.
This tool may appear in graph form and therefore may additionally ensure the conformity of the ads, on the part of the vendor, of a discount or of a sale.
The display on the present site of the term « discount », next to the description of one or more goods or services, is decided by Prixi.us, according to the variations in price that the relevant item or service is subject to over a course of time determined by Prixi.us. The same is true of the term « sale », during legal time periods when the price displayed by the seller represents a true drop in price is relation to the sales price before the “sale” period began.
For this reason Prixi.us can in no way guarantee that the display of the terms « discount », « sale », « reduction in price », or « new in » in the description of an item or service such as it may be displayed on the site of the supplier of the said item or service, will correspond to reality. Nor can Prixi.us guarantee that the appearance of the term "best price" on an item or service featured on Prixi.us, reflects a reality for the whole of the internet, this term indeed only referring to prices relating to goods and services offered by the suppliers referenced on the site.
3. Personal Space
The creation of a personal space by the user is an essential prelude to using certain of the site’s functions. To this end, the member is invited to provide a certain amount of personal information. The member agrees to provide exact information. The collection of data is aimed at creating a "personal space". This account allows the member to consult all the information he/she gives at the time of registration and to enable him/her to manage any information potentially accessible to other users.
If the personal space or the data that it contains should disappear for some unexpected reason, a technical failure or act of God, the site and its’ administrator can in now way be held responsible, this information having no probative value and serving only to inform.
When the user creates his/her personal space, he/she is invited to provide a password. This password is the guarantee of confidentiality of information contained in the personal space and the user should not communicate it to a third party. Should the user pass on his password, the site cannot be held responsible for the unauthorized access to a user’s account.
Prixi.us reserves the exclusive right to suspend or remove the account of any member who fails to respect the present terms and conditions of use (especially but not exclusively, in the event of a member supplying erroneous information at the time of his/her registration and the creation of his/her personal space) or of any account that remains inactive for at least a year. This deletion or removal cannot be considered as « damage » to the excluded user and he/she may not as a result claim for compensation. In such a case, the member is invited to contact the site administrator, either to find an amicable solution, to discuss disputes, or to confirm to Prixi.us the user’s express wish that his account be retained. In all events, Prixi.us’s decision to remove an account cannot be contested on the part of a member.
This exclusion does not exclude the possibility, for Prixi.us, of taking legal action against a member, where the facts deem it justifiable.
Prixi.us cannot however guarantee the truth, the integrity or honesty of information given by members and cannot be held responsible for false declarations made by a member nor can he be held responsible for any such information given on the site.
4. Mail alerts
Members registered on the present site will be bale to create and configure « shopping alerts ».
These alerts may be associated with a specific item or service, or be associated with the results of a specific search carried out by the member on the site. These alerts could thus inform the member that a « sale » or « reduction » has occurred for the item or service that interests him/her, or may alert them to a change in the stock status of the vendor of a given item..
Alerts concerning price reductions and/or the appearance of « discounts » or « sales » may simply refer to the appearance of a drop in price, or inform a member that a particular item or service now falls into a price range or corresponds to a drop in terms of percentage of the original price, that the member has already specified.
Alerts relating to the appearance of an item may either refer quite simply to the appearance of an item as part of the stock of a given vendor, or refer to the availability of the said item as part of a vendor’s stock, following its being out of stock. These alerts may also mention the number of days that the item has been available for, according to the criterion established by the user.
In order to create and configure a "shopping alert", members must log on to their personal space and follow the instructions. The creation and modification of a shopping alert is totally free of charge.
5. Administrator’s Newsletter
By ticking the box provided, or by giving his/her consent, users accept that Prixi.us may send them, with the frequency and in the form that the user specifies, a newsletter containing information about developments at Prixi.
When the user ticks the relevant box, he accepts to receive commercial propositions from Prixi.us of the site relating to services similar to those bought.
Registered members can choose to stop receiving the newsletter by clicking on the link provided to this effect, which features on all newsletters.
6. Collection of cookies
In order to provide all internet users optimal navigation on the site, as well as ensuring the most efficient use of the various applications and interfaces, Prixi.us may plant a cookie on the user’s workstation. This cookie stores information relating to the navigation of the site (date, page, hours), as well as any information that may be provided by the user during his visit (searches, login, email, password). These cookies may remain on the user’s workstation for a variable period of up to 6 months and may be read and used by Prixi.us should the user make a subsequent visit to the site.
Moreover, Prixi.us reserves the right to collect the public IP address (Internet Protocol) of all the users. This IP address will be collected in an anonymous way, will be stored for the same length of time as the cookies and will only be used to ensure the smooth operating of services offered by the site.
The user may block or modify the length of time that this information is retained, and may delete the cookie using the browser interface (generally : tools or options / private life or confidentiality). In such cases, navigation on the present site will not be optimal. If the systematic de-activation of cookies on the user’s browser prevents him/her from using certain services or functions provided by Prixi.us, this dysfunction may in no way give rise to compensation to the user who may not lay claim to any due repairs.
Internet users are also able to delete the cookies already present on their computer, by going to the menu in their browser provided for this purpose (generally, tools or options / private life, confidentiality). Taking such action will not affect web browsing on the present site, but prevents users from benefitting from the services provided by the cookie. In such cases, users must re-enter all information concerning them.
7. Exoneration of Prixi.us’s responsibility with regard to respect of the present contract
In the event of a dysfunction or of it becoming impossible to access the site due to technical problems or other, the client may not lay claim to damages or compensation.
The in-availability, for a long period of time and with no specified time length, of one or more goods or services of the sites referenced on the present site, cannot be considered to cause harm to the user and may not give rise to damages or interests on the part of the site or its administrator.
Photographs and graphics of items present on the site are in no way contractual, Prixi.us. cannot not be involved if the characteristics of an item differ to the image appearing on the site nor if these images are incomplete or incorrect.
The links on the present site may send users to other internet sites and Prixi.us may not be held responsible if the content of these sites breaks the law. In no way is Prixi.us responsible if the user’s visit to one of these referenced sites, should cause him to sustain damage.
The totality of the data published on the present site is in no way contractual and Prixi.us is not responsible for it. The use of the data published on the present site by users is their own responsibility. Prixi.us cannot in particular guarantee that the display of the terms « discount », « sale », « price reduction », or « new in » on the description of an item or service is true, it being only what is displayed on the web site of the vendor of the said item or service. Neither can Prixi.us provide a guarantee that the display of the term "best price" attached to an item or service featured on the site reflects a reality relating to the whole Internet, this term only relating to goods and services offered by suppliers referenced on the present site.
Since the use of the present site is totally free of charge, Prixi.us will in no way pay damages or interest, direct or indirect, nor give compensation for issues resulting from the use of data published on the present site by members and users.
Prixi.us and the authors of any information and advice published on the present site, can in no way be held responsible for it, it being up to the member or user to judge as to the relevance and veracity of the said information and/or advice.
Prixi.us is in no way responsible for the conformity, good condition, and proper functioning of goods and services referenced on the present site, that users may subsequently purchase from sites which are themselves referenced on the present site.
8. Intellectual property rights relating to items published on the present site
The totality of items on the present site belong to Prixi.us. Any copying of logos, textual content graphics or video, and other not listed, is strictly prohibited and will be regarded as fraud. Any member guilty of counterfeiting elements from the site is liable to have his/her account removed without warning or compensation and without this removal giving him claim to damages or interest, and may lead to prosecution, by Prixi.us or his representative.
9. Diverse clauses
The present terms and conditions of use may be modified at any time by Prixi.us or its’ representative. The terms and conditions of use that apply to the user are those in force at the time of his/her log-on to the site. Prixi.us agrees to keep all previous versions of the terms and conditions and to communicate them to any user who requests it.
Excepting the prevision of public order, all disputes that may arise through the application of the present terms and conditions of use should be submitted to the site administrator prior to any legal proceedings with a view to finding an amicable solution. It is expressly stated that a request for friendly solutions does not over-ride the legal deadlines set for the launching of legal proceedings.
If any of the clauses of the present terms and conditions of use should be declared null and void by judicial decision, this would not affect the other clauses which would continue to be valid and would continue to apply.
